PRIVACY POLICY

1. INTRODUCTION

1.1. This privacy policy (the “Policy”) governs the mode and manner in which Opix Technology Limited obtains, uses and processes the personal data shared by you. We comply with all applicable laws, including the Data Protection Act, 2003 (the “2003 Act) while ensuring that the personal data is fully protected and processed lawfully.

1.2. Opix Technology Limited is a limited liability company incorporated under the laws of International Business Companies Act, 2016 (hereinafter referred to as “we”, “us” or the “Company”).

1.3. This Policy sets out the following:

  • the different kinds of personal data that the Company obtains, collects and retains;
  • the purposes for which the Company obtains, collects and retains such person data;
  • the manner in which the Company collects the personal data
  • the manner in which you may collect the person data the Company holds and how the same may be rectified;
  • the manner in which you can lodge a complaint with the Company for breach of this Policy or any applicable law, and how we will deal with such complaint;
  • third party disclosures, including disclosures to such parties that are residing or based overseas;

1.4. This Policy is majorly pertinent to the mode and manner in which the Company carries out the functions relating to its recruitment and organizational development. This includes, but is not limited to analysis and planning in connection with recruitments and branding and marketing exercises such as competitor analysis and networking events (hereinafter collectively referred to as the “Activities”).

1.5. However, you hereby understand, represent and warrant that this Policy shall not applicable to all such personal data collected by the Company which is exempted under the 2003 Act. This includes, but is not limited to handling of records of the employees which are maintained under the employer-employee relationship.

2. WHY DO WE COLLECT, STORE, USE AND DISCLOSE PERSONAL DATA?

2.1. The Company collects personal data for the sole purpose of the Activities stated above.

2.2. For the avoidance of doubt, it is clarified that the term Activities also include all such processes which are in connection with promotional activities, evaluation and analysis of recruitment data in order to improve the Company’s strategy towards recruitment, hiring of candidates, referrals from other parties (which includes staff and the external recruiters).

3. WHAT INFORMATION IS COLLECTED?

3.1. There are different kinds of personal data that the Company may collect from you. This includes, but is not limited to your name, address, bio-data, mobile number, email address, professional details such as details regarding previous jobs, employment history, current and previous salaries and referrals, information specified in the identity documents (for example national identity card, driver’s license or passport), gender, data of birth, educational qualifications, current and past visas, status of work permits, bank details, all such information of your spouse and dependents, and all such information which may be necessarily required  in connection with the Activities (collectively referred to as the “Personal Data”).

3.2. You hereby understand and acknowledge that in addition to collection of the Personal Data, we may also collect some sensitive information in order to provide and perform the Activities. Such sensitive data includes, but is not limited to data in relation to your previous criminal records, professional memberships and information in relation to your health such as current or previous disabilities (collectively referred to as the “Sensitive Data”).

3.3. You hereby understand and acknowledge that you in order to perform the Activities, we will need access to the Personal Data, and the Sensitive Data in some cases. Thus, you cannot remain anonymous. It is also not practical for us to allow you to use a pseudonym.

4. HOW DO WE COLLECT PERSONAL DATA AND SENSITIVE DATA?

4.1. There are various ways in which we collect your Personal Data and Sensitive Data. This includes, but is not limited to:

  • physically;
  • over telephone;
  • through correspondence sent by the Company, which can take any form i.e., physical, electronic or digital correspondence;
  • through a questionnaire, survey or a form which is completed by you; and
  • through website or social media profiles of the Company.

4.2. We may even collect the Personal Data and Sensitive Data through information which is publicly available.

4.3. We will normally collect the Personal Data and Sensitive Data from you directly, if such data relates to you. However, we also reserve the right to collect such data from third parties, which includes but is not limited to referees of the candidate, external recruiters or records which are publicly available.

5. HOW TO DO WE STORE PERSONAL DATA AND SENSITIVE DATA?

5.1. The Company stores Personal Data and Sensitive Data in either conventional hard copies or electronic formats, depending on the nature of the data.

5.2. We shall use our reasonable best efforts to ensure that the Personal Data and Sensitive Data are held securely in whatever format it is stored. The securities measures includes, but are not limited to storing files in locked storages and containers, giving restricted access only to authorized individuals to access such data, firewalls, passwords and other related technological means.

6. HOW DO WE USE AND DISCLOSE PERSONAL DATA AND SENSITIVE DATA?

6.1. The Company shall be entitled to use and disclose Personal Data and Sensitive Data to third parties only for the purposes of performance of the Activities, or as stated otherwise.

6.2. You hereby acknowledge and understand that the Company is affiliated with multiple other companies. As such, it has international offices located all across the globe. Thus, it is necessary for the Company to use multiple resources which are situated all across the globe. The Company shall therefore be entitled to disclose Personal Data and Sensitive Data to its affiliated companies, third parties which are acting on behalf of the Company and other suppliers which are situated in other countries. However, the Personal Data and Sensitive Data may only be shared with such parties if the same is being done in connection with the performance of the Activities. Such transfer may take any form whatsoever.

7. WHAT RIGHTS DO YOU HAVE?

7.1. Any Personal Data or Sensitive Data that you provide to the Company may be accessed by you if the same relates to you.

7.2. If the Personal Data or Sensitive Data does not relate to you, you only access it under certain circumstances which are required or permitted under the applicable laws, including the 2003 Act.

7.3. In the event you want to use the Personal Data or Sensitive Data, you should send us a written request to the email address which is specified in this Policy. We reserve the right to ask your prove your identity before any such access is granted to you. We will endeavor our best to respond within a reasonable period of time, however, we are under no obligation to do so.

7.4. The Company uses best reasonable efforts to ensure that the Personal Data and the Sensitive Data retained is kept complete, up-to-date and accurate at all times. You shall be entitled to request a correction of the Personal Data and / or the Sensitive Data that relates to you, in the event that it is reasonably necessary to do so. Any such request shall be in written and sent to the email address which is specified in this Policy. We reserve the right to ask you to prove your identity before any such request is granted to you. We will endeavor our best to respond within a reasonable period of time, however, we are under no obligation to do so. If the Company rectifies such data after the request has been made, we may take appropriate steps to notify the individual about such change to whom such data relates.

7.5. In the event that you have any issues with our compliance with the applicable laws or the Policy, or the purpose for which or the mode and manner in which we are handling Personal Data and Sensitive Data, you may lodge a complaint in writing to the email address specified in this Policy. Please make sure that you specify all the details in the complaint including the reasons why you believe that the Personal Data and/or Sensitive Data is being handled in a non-compliant manner. Upon receipt of the complaint, we will consider it and respond within a reasonable period of time. We will intimate you of any actions which we may take in respect of the complaint.

7.6. In the event you are not satisfied with the response and actions taken by us in respect of the complaint in section 7.6 of the Policy, you may also make a complaint to the Department of Information Communications at ict.gov.sc.

7.7. We will be under no liability to consider, respond to or take action in relation to complaints which are not in connection with handling of Personal Data and / or Sensitive Data. Please refrain from making any complaint under this Policy which is in connection with your recruitment process.

8. CHANGES TO THE POLICY

8.1. We reserve the right to change the Policy without any providing any prior notice to you. Make sure that you are always familiar with any updates/ changes/ amendments.
